1. Eligibility and Acceptance

You must be at least 18 years of age and have the legal capacity to enter into binding contracts. By using this website or our services, you represent that you meet these requirements and that you accept these Terms unconditionally. The mere use of this website constitutes acceptance. SWHI services are available to customers located in the United States only.

2. Electronic Communications

By using this website or communicating with us electronically, you agree that we may communicate with you through our website or by email. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any applicable legal requirement that such communications be in writing.

3. Intellectual Property

SWHI and its licensors own and control all copyright and other intellectual property rights in this website and all data, information, and other resources displayed on or accessible through it.

Unless specific content expressly indicates otherwise, you are not granted a license or any other right under copyright, trademark, patent, or other intellectual property law. You may not use, copy, reproduce, perform, display, distribute, alter, reverse engineer, decompile, transfer, transmit, monetize, sell, or commercialize any resources on this website in any form without our prior written permission, except to the limited extent permitted by applicable mandatory law.

4. Third-Party Websites and Content

Our website may contain hyperlinks or references to third-party websites. We do not monitor, review, or endorse the content of those websites. Products and services offered by third-party websites are subject to the terms and conditions of those respective parties. We accept no responsibility for any loss or damage arising from your use of third-party websites or your disclosure of personal information to them.

5. Acceptable Use

You agree to use our website and services only for lawful purposes and in accordance with these Terms and all applicable laws and regulations. The following are strictly prohibited:

• Spam and unsolicited messaging. Sending unsolicited bulk email, operating mailing lists without verified opt-in consent, or flooding newsgroups or online communities is prohibited. Violations may result in immediate account termination and a penalty of $200.00 per incident, plus all legal fees and damages incurred by SWHI. Hosting any entity listed in the Register of Known Spam Operations (ROKSO) is forbidden.
• Malicious software. Publishing, distributing, or linking to any material that constitutes or contains malicious computer software, including viruses, trojans, ransomware, or spyware.
• System abuse. Attempting to gain unauthorized access to any account, server, or network; circumventing security controls; or interfering with the performance or availability of SWHI infrastructure or any third-party system.
• Prohibited content. Hosting, transmitting, or storing content that is unlawful, threatening, abusive, defamatory, obscene, or that infringes upon the intellectual property rights of any third party. SWHI reserves the right to remove any such content without prior notice.
• Unauthorized data collection. Conducting systematic or automated data collection activities on or in relation to our website without express written permission.
• Resource abuse. Excessive consumption of server resources — CPU, memory, bandwidth, or storage — that adversely affects other customers. SWHI may throttle, suspend, or terminate accounts engaged in resource abuse.

6. Billing, Payment, and Renewals

• Payment in advance. All services are billed in advance for the selected billing period. Payment is due at the time of purchase.
• Late payment. If renewal payment is not received within five (5) days of the due date, service may be suspended. A reconnection fee equal to twice the applicable monthly rate will apply to restore suspended service.
• Account termination. Accounts past due by more than thirty (30) days may be terminated. Reinstatement requires payment of all outstanding balances, a six-month prepayment, and a non-refundable reinstatement fee of $75.00.
• Returned payments. A $50.00 service fee will be assessed for any returned check or reversed electronic payment.
• Collections. If SWHI engages a collection agency or legal counsel to recover outstanding amounts, you agree to pay all associated costs, including reasonable attorney's fees.
• Price changes. SWHI reserves the right to modify pricing upon notice posted to our website. Continued use of services after a price change constitutes acceptance of the new pricing.

7. Cancellation and Refund Policy

Right of withdrawal. You may cancel your service within 14 days of the initial purchase without providing a reason, provided that service provisioning has not yet commenced at your request. To exercise this right, notify us in writing at info@swhi.net before the 14-day period expires. We will confirm receipt promptly.

• Non-refundable fees. Setup fees, the first billing period, and domain registration fees are non-refundable once service has been provisioned or the domain has been registered with the registry.
• Pro-rata refunds. For prepaid billing periods, unused time beyond the first period may be refunded on a pro-rata basis, provided the refund amount exceeds the equivalent of one month's service. Refunds are issued to the original payment method.
• Services rendered during withdrawal period. If you requested that service begin during the 14-day withdrawal period and then choose to withdraw, you agree to pay a proportionate amount for the service provided up to the date of cancellation.
• How to cancel. Submit a written cancellation request to info@swhi.net.

8. SMS Notifications

SWHI offers optional SMS account notifications. By affirmatively checking the opt-in checkbox during checkout — which is unchecked by default — you provide express prior written consent to receive text messages from SWHI regarding your account (e.g., account activation confirmations and service notices). We do not send promotional or marketing text messages. You may withdraw consent at any time by replying STOP to any message, or by contacting us at info@swhi.net. 9. Idea Submissions

Please do not submit ideas, inventions, creative works, or other content that you consider your intellectual property unless we have first executed a written agreement addressing ownership or confidentiality. If you disclose such material to us without such an agreement, you grant SWHI a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, store, adapt, publish, translate, and distribute that content in any existing or future medium.

10. Service Availability and Termination

SWHI may, in its sole discretion, modify, suspend, or discontinue access to the website or any service, temporarily or permanently, with or without notice. You agree that SWHI will not be liable to you or any third party for any such modification, suspension, or discontinuation. You must not circumvent or attempt to circumvent any access restriction measures on our website or services.

11. Data and Backups

You are solely responsible for maintaining independent backups of all data hosted on SWHI servers. While SWHI may perform periodic server-level backups as a courtesy, we do not guarantee the availability, completeness, or recoverability of any backup. SWHI is not liable for any loss of data, regardless of cause.

12. Disclaimer of Warranties

THIS WEBSITE AND ALL CONTENT AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. SWHI DOES NOT WARRANT THAT THE WEBSITE OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. NOTHING ON THIS WEBSITE CONSTITUTES LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE OF ANY KIND.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SWHI AND BOUNCER ENTERTAINMENT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, REVENUE, OR BUSINESS — ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OUR SERVICES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE. OUR MAXIMUM AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO SWHI IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless SWHI, Bouncer Entertainment LLC, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or relating to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any content you host, transmit, or store using our services.

15. Privacy

Your use of our services is subject to our Privacy Policy, which is incorporated into these Terms by reference. You agree to provide accurate, current, and complete information when creating an account or placing an order, and to keep that information up to date.

16. Export Restrictions and Legal Compliance

Access to this website from jurisdictions where the content or purchase of our products or services is unlawful is prohibited. You may not use our services in violation of any applicable United States export laws or regulations.

17. Assignment

You may not assign, transfer, or sub-contract any of your rights or obligations under these Terms, in whole or in part, to any third party without our prior written consent. Any purported assignment in violation of this section is null and void. SWHI may assign its rights and obligations under these Terms without restriction.

18. Breaches and Enforcement

Without prejudice to any other rights available to us, if you breach these Terms in any way, SWHI may take any action it deems appropriate, including temporarily or permanently suspending your access to our services, notifying relevant authorities, or commencing legal action against you.

19. Force Majeure

Except for payment obligations, neither party shall be in breach of these Terms for any delay or failure to perform its obligations where such delay or failure arises from any cause beyond that party's reasonable control, including acts of God, natural disasters, government action, labor disputes, or failures of third-party infrastructure.

20. Waiver

Failure by SWHI to enforce any provision of these Terms or to exercise any right or option available to us shall not constitute a waiver of such provision or right, and shall not affect the validity of these Terms or our right to enforce any provision thereafter.

21. Modifications to These Terms

SWHI reserves the right to modify these Terms at any time. Changes take effect upon posting to our website. We will make reasonable efforts to notify subscribers of material changes by email. Continued use of our services after any modification constitutes acceptance of the revised Terms.

22. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Hendry County, Florida, and you hereby consent to personal jurisdiction in those courts.

23. Language

These Terms and all related notices and correspondence shall be interpreted and construed exclusively in English.

24. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SWHI with respect to your use of this website and our services, and supersede all prior or contemporaneous understandings, agreements, and representations. If any provision is found to be unenforceable, the remaining provisions shall continue in full force and effect.
